The Personal Data Protection Law (KVKK) was published in the Official Gazette on April 7, 2016, and entered into force.

  • KVKK: The Law No. 6698 on the Protection of Personal Data, published on April 7, 2016.
  • Data Processor: A real or legal person who processes personal data on behalf of the data controller.
  • Data Controller: A real or legal person who determines the purposes and means of processing personal data.

RIGHTS OF THE DATA SUBJECT UNDER ARTICLE 11 OF KVKK

Under Article 11 of KVKK, data subjects have the right to:

  • Learn whether their personal data has been processed,
  • Request information if their personal data has been processed,
  • Learn the purpose of processing and whether the data is used for the intended purpose,
  • Know the third parties to whom their personal data is transferred,
  • Request correction of incomplete or incorrect data,
  • Request deletion or destruction of personal data,
  • Request notification of corrections or deletions to third parties,
  • Object to any outcome against them resulting from automated data processing,
  • Demand compensation if they suffer damages due to unlawful processing.

CASES WHERE CONSENT IS NOT REQUIRED

Under Article 5(2) of KVKK, personal data may be processed without explicit consent in cases where:

  • Processing is explicitly required by law,
  • Processing is necessary for contract establishment or performance,
  • Processing is required to fulfill a legal obligation,
  • The data is made public by the data subject,
  • Processing is necessary for the establishment, exercise, or protection of a right,
  • Processing is necessary for the legitimate interests of the data controller.
